City lawyer Kabenge sues law firm that prosecuted him over land fraud
COURT | City lawyer Kavuma Kabenge has dragged Tumusiime, Kabega and Company Advocates to court, accusing the law firm of maliciously prosecuting him under the pretext of representing its clients.
Kabenge says that the law firm whose senior partners are Enos Tumusiime and criminal law giant MacDosman Kabega filed a suit against him on behalf of Jacko Chagga, Joanita Ochieng and Linda Ochieng.
The trio, Kabenge says, accused him of being in breach of his duty as an advocate when he transferred the land comprised in block 203 plot 5065 and 5066 found in Nansana, Wakiso district into the names of one Charles Balaba Lulya without the conset of Joanita and Linda.
“The defendants without lawful reason alleged that the plaintiff [Kabenge] forged and witnessed the signatures on the transfer forms,” Kabenge’s suit says, “yet they know that it’s true.”
According to Kabenge his accusers know that the allegations in their case aren’t true and that the land was duly sold to by Rehema Namuli Ochieng the mother of Linda Joanita and Linda to Isaac Isanga Musumba the minister of for state for Urban Development.
This fact, Kabenge the former Express Football Club chairman, says was brought to the attention of all this accusers but he says they” chose to file the case and continued with same malice.”
“By reason of the aforesaid acts of the defendant the plaintiff suffered psychological torture, mental anguish, untold in-convenience and damage for which he holds the defendants liable by way of general damages…” Kabenge’s plaint says before asking for punitive and general damages.
